These Terms of Service ("Terms") govern your use of TelegramFX Copier software and services ("Service") provided by MD Brands LLC ("Company", "we", "us", "our"), a Delaware limited liability company based in Chicago, Illinois.

By subscribing to, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

We are not registered with the CFTC (Commodity Futures Trading Commission), NFA (National Futures Association), SEC (Securities and Exchange Commission), or any other financial regulatory authority. We do not provide investment advice, trading recommendations, or financial guidance of any kind.

SOFTWARE TOOL ONLY: Our software automates the copying of trading signals from Telegram channels to your trading accounts. We have no control over, do not endorse, and are not responsible for the quality, accuracy, or profitability of any signals from third-party Telegram channels.

1. Service Description

MetaAPI Requirement: Our Service requires a MetaAPI subscription, which must be purchased separately from MetaAPI.cloud. We have no control over MetaAPI's pricing, availability, or service quality. MetaAPI outages, changes, or disruptions may affect the functionality of TelegramFX Copier. We are not responsible for any losses resulting from MetaAPI service issues.

Telegram API: Our Service relies on Telegram's API infrastructure. We are not responsible for Telegram service interruptions, API changes, or delays in signal delivery.

Broker Compatibility: Trading execution via MetaAPI uses the built-in API connection feature of MetaTrader 4 and MetaTrader 5. While most brokers support this built-in API functionality, not all do. It is your responsibility to verify that your broker supports MT4/MT5 API connections before subscribing. We are not responsible if your broker does not support or restricts API trading.

Past Performance Does Not Guarantee Future Results

Any backtesting data, historical performance metrics, or channel analytics provided through our Service or mltiplAI platform is for informational purposes only. Past performance is not indicative of future results.

Backtesting data may not reflect actual trading conditions, slippage, spread costs, execution delays, or market volatility. Actual trading results will differ from backtested performance.

2.1 No Guarantees

We make NO guarantees, warranties, or representations regarding:

We do not exercise any control over market prices or price feeds. All pricing is determined by your broker and market conditions. We are not responsible for price slippage, spread widening, requotes, or execution quality.

2.2 Third-Party Signal Providers

You acknowledge that all trading signals originate from third-party Telegram channels that we do not control, operate, endorse, or verify. We have no relationship with signal providers and make no representations about their legitimacy, accuracy, or profitability.

You are solely responsible for evaluating and selecting which Telegram channels to follow. We provide analytical tools and historical data to assist your research, but you must conduct your own due diligence.

3. User Responsibilities & Conduct

3.1 Learning Curve & Technical Competence

All software has a learning curve. TelegramFX Copier is a sophisticated trading automation tool that requires time and effort to learn properly. You are responsible for:

⚠️ MANDATORY DEMO TESTING

We STRONGLY REQUIRE that you test the Service on a demo account before using real money. Users who immediately deploy the software on live accounts without testing experience significantly higher failure rates.

If you suffer losses because you did not test properly on a demo account first, that is your responsibility, not ours. We will not issue refunds for losses caused by your failure to test configurations before live trading.

We provide support, but we cannot teach you how to trade. If you don't understand basic trading terminology or concepts, you should not be using automated trading software.

Professional Conduct Expected

We're here to help, and we're invested in your success. Our support team will assist you with technical issues, configuration questions, and troubleshooting. However, we cannot accommodate unreasonable demands.

4. Subscription & Billing

4.1 Subscription Plans

TelegramFX Copier is offered on a subscription basis with monthly, quarterly, semi-annual, and annual billing options. Pricing is available at app.telegramfxcopier.io/pricing.

4.2 Recurring Billing

By subscribing, you authorize us to charge your payment method automatically at each billing cycle. Subscriptions automatically renew unless canceled before the renewal date.

4.3 Price Changes

We reserve the right to change pricing at any time. Price changes will apply to renewals after the change takes effect. We will provide at least 30 days notice of price increases for existing subscribers.

4.4 Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

4.5 Chargebacks

Filing a chargeback without first contacting support is considered fraud. Chargebacks result in immediate account termination and may result in legal action to recover costs plus damages. We report fraudulent chargebacks to payment processors.

5. Refund Policy

Trading losses are NOT grounds for refunds. We provide software tools, not trading guarantees. If you lose money following signals from Telegram channels, that is not our responsibility and does not entitle you to a refund.

6. Limitation of Liability

Maximum Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MD BRANDS LLC'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

We are not responsible for failures or delays caused by events beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, internet outages, third-party service failures, or government actions.

7. Intellectual Property

All content, features, functionality, software, designs, text, graphics, and trademarks associated with the Service are owned by MD Brands LLC and protected by U.S. and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal trading purposes only. You may not copy, modify, distribute, sell, or lease any part of the Service.

Your use of the Service is also governed by our Privacy Policy available at telegramfxcopier.io/privacy-policy/.

8.1 Trade Data Usage

By using the Service, you grant us permission to utilize your anonymized trade data for testing, analytics, and service improvement purposes. This includes but is not limited to:

Your personal identifying information is NOT shared publicly. All trade data used for analytics is anonymized and aggregated. We may display aggregated statistics (such as "this channel has X win rate across Y users") but will never reveal individual user trading performance or personally identifiable information.

8.2 Data Accuracy

While we strive to provide accurate analytics and backtesting data through mltiplAI, we do not guarantee the accuracy, completeness, or timeliness of any data. You should independently verify any information before making trading decisions.

9. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

Classic Edition (Desktop Software) Notice: The desktop version of TelegramFX Copier is no longer sold to new customers. Existing lifetime license holders retain access to the software and helpdesk support, but live chat support for Classic Edition has been discontinued.

10. Termination

10.1 Termination by You

You may terminate your subscription at any time by canceling through your account dashboard or contacting support. Access continues until the end of your current billing period.

10.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

Termination for cause (violation of Terms) results in no refund of any kind.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles.

11.2 Arbitration Agreement

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. Arbitration shall take place in Chicago, Illinois.

You waive your right to participate in class action lawsuits or class-wide arbitration. All disputes must be brought on an individual basis only.

11.3 Exceptions to Arbitration

Either party may bring a claim in small claims court if it qualifies. We may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property or prevent unauthorized use of the Service.

12. Miscellaneous

12.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and MD Brands LLC regarding the Service.

12.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

12.5 Updates to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new "Last Updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
